Parcel 4 The Miamisburg Closure Project

On April 19, 2001, the Miamisburg Mound Community Improvement Corporation (MMCIC) obtained ownership of Miamisburg Closure Project’s Parcel 4, or the “South Property”.  Parcel 4 consists of 94.8 acres of land which was mostly used for agricultural purposes prior to the Department of Energy’s purchase in 1981. There are no structures or buildings within the parcel. The parcel remained undeveloped except for a paved road going from Benner Road to the MMCIC owned land known as Miamisburg Closure Project’s Release Block D.

The Parcel 4 Record of Decision, Mound Plant, Final, February 2001, provides the details of this land transfer. This document referred to as Parcel 4 ROD can be found in the Miamisburg Closure Project (formerly Mound) CERCLA Public Reading Room located at the Miamisburg Senior Adult Center, 305 Central Avenue, Miamisburg, Ohio.

As a result of the risk assessment, completed and published as the Parcel 4 Residual Risk Evaluation, Final, February 2001, institutional controls in the form of deed restrictions were placed on Parcel 4 to ensure the protection of human health and the environment. The deed restrictions for Parcel 4 are as follows:

• Maintenance of industrial/commercial land use;
• Prohibition against residential use;
• Prohibition against the use of ground water;
• Site access for federal and state agencies for the purpose of sampling and monitoring, and;
• Prohibition against removal of Parcel 4 soils from the Department of Energy (DOE) Miamisburg Closure Project property (as owned in 1998) boundary without approval from the Ohio Department of Health and the Ohio Environmental Protection Agency (Ohio EPA).

DOE has the responsibility to monitor, maintain and enforce these deed restrictions. This responsibility includes an annual assessment of compliance with the deed restrictions and enforcement action for noncompliance. As in past assessments for previously transferred land, the United States Environmental Protection Agency and Ohio EPA are expected to complete the assessments with DOE.
